Event Terms & Conditions

By purchasing, holding or using an Event Ticket, and/or by entering or attending the Event, you agree to comply with these Terms & Conditions, including the provisions relating to intellectual property, event format, filming, photography, confidentiality and permitted use of Event content.

In these Terms & Conditions, the “Organiser”, “Us”, “Our”, or “We” means What Does Not LTD and “Event”, “Event Ticket” shall mean any event, exhibition or show printed on this ticket or any future tickets for all future events.

1. RAW, NOISE, AFTERNOISE BARE, ROVE, POV AND ALL OTHER EVENTS BY WDN (“Event”), held various venues across London (“Venue”) is organised and managed by What Does Not Limited (“Organiser”), a company incorporated in England and Wales with company number 12592348 with registered office at Forma House, 40 Bowling Green Lane, London, England, EC1R 0NE

2. Visitors can attend the Event with: (a) a general admission ticket (which may include a welcome drink in certain occasions), and includes entry to the Event on the date and at the time stated on the ticket (“General Admission”, “Musicians & Artists”, “Pay What You Can (All Tiers) and “Under 25”)

3. A valid Event Ticket entitles the holder to attend the Event on the dates and at the times stated on the Event Ticket.

4. Visitors holding an Event Ticket may also choose to purchase an Add On ticket (“Add On”). Event Ticket holders who purchase a Add On shall, in addition to all terms as set out hereunder, be bound by the Add On Terms.

5. Notwithstanding the means by which a visitor holds an Event Ticket, the General Terms, Entry Conditions, and Refund Terms (to the extent set out therein) apply to all visitors attending the Event.

6. We respect your Personal Data and shall deal with it in accordance with our Privacy Policy and applicable UK Data Protection legislation in place from time to time. Please see our Privacy Policy for further details.

1. There shall be no admittance to the Event without a valid Event Ticket.

2. All holders of an Event Ticket agree to be bound by these Entry Conditions, those as detailed on the Event Ticket, and such other terms as are drawn to the attention of visitors by the Organiser and/or by any third party seller of Event Tickets (as applicable).

3. It is the Event Ticket holder’s responsibility to check his or her Event Ticket(s), as mistakes cannot always be rectified and the Organiser shall not be responsible for any incorrect Event Tickets.

4. Event Tickets may not be used as prizes in competitions, “give-aways” or a lottery without the prior written consent of the Organiser in its sole discretion.

5. At certain, not all, events ticket holders may be entitled to one free drink on the night – subject to availability. The drinks sponsor, What Does Not and The Venue reserve the right to withdraw this promotion at any time, for whatever reason, and in the case where all the stock has run out. Events that include free welcome drinks will be clearly marketed as such.

6. At events which include welcome drinks, guests will be handed a token at the door which may be exchanged at the designated bar for a free drink. Tokens cannot be exchanged for drinks on the venue’s main menu – only the specific welcome drink created for the event, sponsored by a drinks brand will be redeemable. A non-alcoholic option may or may not be available – subject to staffing and stock.

7. Event Tickets must not be resold, exchanged, transferred, altered or defaced. Any such action shall render the Event Ticket(s) void (and any individual with such an Event Ticket may be refused entry or removed from the Event in Organiser’s sole discretion).

8. On entry to the Event all visitors agree to accept and abide by any venue rules of the venue (“Venues”) (as may be updated from time to time) and any other regulations from time to time provided on entry to the Venue.

9. The Organiser shall not be responsible for any lost or stolen Event Tickets.

10. All Event Ticket sales are final and unless otherwise stated herein (or in any Third Party Terms, if applicable), no refunds, cancellations or exchanges are available after an Event Ticket has been purchased.

11. Event Tickets are issued subject to, and these Entry Conditions incorporate, the rules and regulations of the venue, and shall remain the property of the Organiser who hereby reserves the right to recall any Event Ticket at any time.

12. Without prejudice to the Refund Terms and any third Party Terms (if applicable), Event Tickets are non-refundable and are issued subject to the Organiser’s right to alter or vary the Event due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange Event Tickets. It is the responsibility of the Event Ticket holder to ascertain the date, time and venue of any rearranged of the Event

13. Organiser reserves the rights to refuse admission to the Event to anyone who does not have a valid Event Ticket (including those which appear to be counterfeit or which have been altered and/or defaced).

14. You are not entitled to purchase any Tickets as a trader acting in the course of business with the intention of reselling your Tickets for profit. If we discover or have reason to suspect that you have purchased and intend to resell, or have sold Tickets in breach of this clause, we reserve the right to cancel your Tickets without notice.

15. You may not resell or transfer your Tickets if prohibited by law. In addition, Event Partners may restrict or prohibit the resale or transfer of tickets for some events. Any resale or transfer (or attempted resale or transfer) of a ticket in breach of the applicable law or any restrictions or prohibition imposed by an Event Partner is grounds for seizure or cancellation of that Ticket.

16. Proof of age may be required for all Ticket types. Please ensure that you have a photo ID with you in case you are asked. Failure to provide such ID may result in you being asked to stop consuming and purchasing alcohol and/or leave the Event. If you look under 25 you may be asked for proof of age when you buy alcohol. We operate the ‘Challenge 25’ policy.

17. Tickets including alcohol can only be purchased by someone aged 18 and over and can only be used by someone aged 18 and over.

1. In order to facilitate the security, safety and comfort of all attendees, Organiser and TRP reserve the right in their absolute discretion to conduct security searches of persons, clothing, bags and all other items on entry and exit to the Event and to confiscate items which may be illegal, cause danger and/or disruption to the Event or other visitors, or are in breach of these Entry Conditions and to refuse admission to the Event. Anyone resisting confiscation of disallowed items or disregarding these conditions will face eviction from the Venue.

2. Organiser reserves the right to:

1. Refuse admission or evict any person who is:

• breaching these Entry Conditions;

• committing a criminal offence;

2. behaving in a disorderly manner or in a way that has an adverse effect on public safety,

• behaving in an anti-social manner or in a way that causes a public nuisance;

• conducting themselves in a manner that is inappropriate to and/or compromises the safety and/or security of other visitors;

• conducting themselves in a manner that is offensive and/or disrespectful to staff; and/or

3. under the influence of drugs and/or excessive alcohol; and/or

• refuse alcohol to any attendee who, in Organiser’s absolute discretion, is unreasonably intoxicated and/or is behaving in an unacceptable manner;

• evict all members of any group of persons where that group is behaving in a persistent anti-social manner.

In the event of an emergency, Event Ticket holders and all visitors to the Event must follow instructions and directions from stewards, staff and/or other officials.

If the Event is an outdoor event and visitors are advised to wear appropriate clothing and footwear at all times.

The following items are prohibited within the Event:

• Sound systems

• BBQs

• No food, soft drinks and alcohol can be brought into the Event unless the food or soft drink is to accommodate access/medical requirements. Please note, this is permitted at the discretion of security.

• No items in glass bottles. These will be confiscated if found.

• No animals (except registered guide/assistance dogs). Please inform organisers of the attendance of any registered guide/assistance dogs prior to arriving onsite.

• Any item which may reasonably be considered for use as a weapon by the Event Organisers

• You may be searched at the entrance for any items that may be used in an illegal or offensive manner – which will be confiscated. Persons suspected of carrying out illegal and/or offensive activities onsite may also be searched and face eviction and may be reported to the authorities.

• Illegal substances

• No Nitrous oxide (laughing gas). As a contraband good, under the Psychoactive Substances Act 2016, this substance is banned.

• Unauthorised items for trading, including any goods using unauthorised event logos.

• Unofficial tabards or reflective jackets

• Electric skateboards, scooters, and bicycles are not permitted.

• Aerosols over 250ml

• Air horns

• No portable laser equipment or pens are permitted.

• Blow torches

• Any item or part of an item that the Organiser considers to be potentially harmful to public safety

• No blow up lay sacks or large seating items or chairs are allowed.

• Unauthorised professional tape recorders, photography, and video equipment. Equipment considered to be professional will be permitted at the discretion of the security, any other items considered to be unsafe or potentially posing a risk to public safety and/ or security.

• Alcohol is not permitted to be taken into the Event and any alcoholic drinks purchased on site must be consumed before leaving. Bag searches will be in operation.

• Climbing or standing upon tables, chairs, benches,  exhibits, or anything similar is strictly prohibited.

• Each visitor is responsible for his/her own personal property brought into the Site.

1. Event goers acknowledge that CCTV cameras will be in operation across the Venue for reasons of security and public interest.

   All sound and moving or still picture rights relating to the Event, including without limitation any rights capable of being exploited on the internet, vest exclusively in the Organiser. Any material captured, filmed or recorded at the Event by an Event goer may only be used for that person’s personal, private and non-commercial enjoyment, unless the Organiser has given its prior written consent.

   By entering the Event, visitors acknowledge and agree that they may be photographed, filmed or otherwise recorded as attendees at the Event, and consent to:

   (a) such photographs, films and recordings, including any image, likeness, mannerisms and/or voice of the visitor contained in them, being used, reproduced, edited, published, communicated, shared and otherwise exploited by the Organiser, its affiliates and authorised third parties for research purposes and any other lawful purpose, including without limitation in impact reports, annual reports, press releases, promotional and marketing materials, editorial content, websites, social media, broadcasts and other print or digital communications, in any and all media worldwide, in perpetuity, without compensation and/or credit;

   (b) being filmed, photographed and recorded for television, radio, webcast and any other public broadcast in any medium, and/or for any video, DVD or similar recording, as part of the audience; and

   (c) where any such photographs, films or recordings constitute personal data, their processing, use and sharing by the Organiser, its affiliates and authorised third parties in accordance with applicable data protection law.

   Entrance to the Event is subject to a prohibition on the use of photographic, filming, sound recording or broadcasting equipment for commercial purposes without the Organiser’s prior written consent. Accordingly:

   (a) a person may be refused entry to, or removed from, the Event if they are found in possession of equipment capable of taking photographs, making films, sound recordings or broadcasts in circumstances where the Organiser reasonably believes that such equipment may be used for commercial purposes, or if they take any photograph, make any film, sound recording or broadcast of anything occurring within the Event for commercial purposes; and

   (b) a person may enter the Event with equipment integrated into electronic communications apparatus designed for personal private use (such as a mobile telephone) and/or with a personal stills camera, provided that such device is not used for commercial purposes. Any person attempting to use such device for commercial purposes may be removed from the Event.

1. All intellectual property rights and other proprietary rights in and relating to the Event are owned by, or licensed to, What Does Not Limited.

2. For the purposes of these Terms & Conditions, “Event IP” includes, without limitation, the Event name, logo, branding, trade marks, visual identity, concept as expressed at the Event, format, structure, sequence, guest journey, audience participation mechanics, creative direction, themes, scripts, prompts, performances, characters, rituals, games, installations, staging, set design, lighting design, sound design, music selection or arrangement, choreography, costumes, artwork, written materials, menus, invitations, digital content, photography, video, production methods, supplier know-how, operational processes, run sheets, and any other creative, artistic, literary, dramatic, musical, technical, visual or experiential elements forming part of the Event.

3. Your Event Ticket gives you a personal, limited, revocable, non-exclusive and non-transferable licence to attend the Event as a guest, subject to these Terms & Conditions. Your Event Ticket does not transfer to you any ownership of, or commercial rights in, the Event, the Event IP, or any part of the Event format.

4. You must not, without the Organiser’s prior written consent:

(a) copy, reproduce, imitate, adapt, restage, recreate, reverse-engineer or create a derivative version of the Event, the Event format, or any substantial or distinctive part of it;

(b) use the Event, the Event format, or any Event IP as the basis for another event, production, experience, performance, party, members’ event, cultural event, brand activation, marketing campaign, commercial concept, pitch, proposal, client project or other public or private event;

(c) copy, photograph, scan, distribute, publish, disclose or otherwise use any scripts, prompts, instructions, written materials, production notes, designs, plans, layouts, confidential materials, backstage materials, operational materials or behind-the-scenes materials made available, displayed or visible at the Event;

(d) use any Event IP in a way that suggests any association, sponsorship, endorsement, partnership, collaboration or approval by the Organiser where no such relationship exists;

(e) use the Event or any Event IP for commercial promotion, paid content, advertising, sponsorship, brand partnership activity or any other commercial purpose, except where expressly agreed in writing by the Organiser; or

(f) authorise, assist, enable or encourage any third party to do any of the above.

5. Unless the Organiser states otherwise at the Event, visitors may share personal, non-commercial photographs or short video clips taken from public guest areas of the Event on their personal social media accounts, provided that such use:

(a) does not disclose confidential, backstage, operational, production, supplier or restricted materials;

(b) does not reveal any restricted performances, scripts, prompts, mechanics, surprises, guest interactions or creative elements which the Organiser has asked visitors not to record or share;

(c) does not misrepresent the visitor’s relationship with the Organiser or the Event;

(d) does not use the Event IP for commercial promotion, paid content, advertising, sponsorship or brand partnership activity without the Organiser’s prior written consent; and

(e) is promptly removed if the Organiser reasonably requests removal because the material infringes rights, breaches these Terms & Conditions, affects another visitor’s privacy or safety, or compromises the Event experience.

6. Certain parts of the Event may include confidential, unreleased, private, embargoed or restricted creative, commercial or operational information. Where any such information is identified as confidential, restricted, private, backstage, embargoed or not for publication, you must not disclose, copy, publish, share, use or exploit that information without the Organiser’s prior written consent.

7. The Organiser reserves the right to refuse entry to, or remove from the Event, any person who breaches or is reasonably suspected of breaching this section. Where lawful to do so, the Organiser may also cancel the relevant Event Ticket without refund, require the deletion or takedown of unauthorised material, and take any further action available to protect its rights, including seeking damages, an injunction, an account of profits, legal costs and any other remedies available by law.

8. This section continues to apply after the Event has ended.

1. You must not use your attendance at, access to, or knowledge of the Event to solicit, approach, engage, employ, contract with, commission or otherwise deal directly with any performer, artist, host, producer, supplier, contractor, creative collaborator, venue partner, sponsor, brand partner, staff member or representative involved in the Event for the purpose of copying, recreating, adapting, restaging, producing, exploiting or developing the Event, the Event format, any Event IP, or any substantially similar event, experience, production, performance, brand activation or commercial concept.

2. You must not knowingly encourage or assist any third party to bypass the Organiser in relation to any commercial opportunity, supplier relationship, creative relationship, performance relationship, sponsorship opportunity, venue opportunity or production opportunity introduced to you through the Event, where the purpose or effect is to copy, recreate, adapt, restage, produce, exploit or develop the Event, the Event format, any Event IP, or any substantially similar event, experience, production, performance, brand activation or commercial concept.

3. This clause does not prevent ordinary social, personal or professional interaction with other visitors or participants at the Event. It is intended only to protect the Organiser’s legitimate business interests, confidential information, creative relationships, supplier relationships, goodwill, Event IP and proprietary event format.

4. This clause applies during the Event and for a period of 12 months after the Event.

1. Each holder of an Event Ticket acknowledges that attendance at the Event is entirely at their own risk and neither the Organiser nor any of its employees, contractors, affiliated entities, or their servants or agents, shall be liable for any loss, injury or damage (to person or property) howsoever suffered by a holder of an Event Ticket, including consequential losses, save for:

• death or personal injury caused by the negligence of the Organiser, its employees, contractors or agents; and

• any other liability that cannot be excluded or limited under applicable laws, including the Consumer Rights Act 2015.

  2.Each Event goer is responsible for any travel and accommodation arrangements for the Event and except as set out in the Refund Terms, Organiser shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to travel or accommodation expenses from postponement, cancellation, abandonment or curtailment of the Event and the Event Ticket holder waives all rights of whatsoever nature against Organiser, its employees, servants, agents, independent contractors or representatives arising from cancellation, abandonment or curtailment of the Event. Nothing in the Terms and Conditions shall exclude or restrict liability for personal injury or death due to negligence.

• These Entry Conditions shall be governed by English law and those bound by them hereby submit to the exclusive jurisdiction of the English courts in connection herewith.

• If any of these Entry Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction in which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from that term and the remaining terms and conditions shall survive and continue to be binding and enforceable.

  3. The ticket holder voluntarily assumes all risks and danger incidental to the event for which the ticket is issued, whether occurring prior, during or after the event. The ticket holder voluntarily agrees that the management, venue, event participants, What Does Not LTD and all of their respective agents, officers, directors, owners, employers and employees are expressly released by the ticket holder from any claims arising from such causes.

• The Organiser expressly reserves the right to change and/or amend these Entry Conditions from time to time.

• By booking tickets for any What Does Not event, you acknowledge that What Does Not (“WDN”) will collect and store the personal data you submit for the purpose of administering your booking and attendance at the event. Where you have opted in, or where WDN is otherwise permitted by law to do so, your information may also be used to send you current and future event updates, including by newsletter. You may unsubscribe from marketing communications at any time by using the unsubscribe link in those communications or by contacting WDN. WDN will not sell your personal data to third parties. WDN may share your personal data with its service providers, affiliates and authorised third parties where necessary for event administration, communications, research, impact reporting and other lawful purposes, or where required by law. Further information about how WDN uses and shares personal data is set out in its Privacy policy.

1. The Event will operate in line with the latest government restrictions. The Operator reserves the right to cancel your Event Ticket(s) should governmental or other regulatory capacity restrictions and/or any decision of another relevant authority relating to COVID-19 be implemented nearer the Event date. In the event of Event Ticket cancellations, the Organiser shall process refunds in accordance with all applicable Terms and Conditions relating to this Event.

2. Where an Event Ticket is purchased on this website, these Refund Terms shall apply in their entirety (in addition to the above General Terms and Entry Conditions).

3. Where any of the following are purchased on a third party ticketing platform, the terms and conditions of that third party (“Third Party Terms”) in addition to the General Terms, Entry Conditions, or any other applicable terms. Where those Third Party Terms reference the terms and conditions of the Organiser in relation to refunds, cancellation, abandonment, curtailment and/or postponement these Refund Terms shall apply to the extent referenced therein, and in the event of conflict between the Third Party Terms and these Refund Terms, the Third Party Terms shall prevail. Please contact the ticketing agent (as applicable) with questions relating to all such matters.

4. If the Event is postponed (whether in its entirety or if the relevant day of the Event to which your Event Ticket relates, is postponed), your Event Ticket and any Add Ons (if applicable) will be valid for the rescheduled Event. Where you are unable to attend the rescheduled Event or where you choose not to do so, you will be entitled to a full refund of the face value of the Event Ticket and any Add Ons (if applicable), but no refund will be given in respect of any other expenditure whatsoever.

5. If the Event is cancelled (whether in its entirety or if the relevant day of the Event to which your Event Ticket relates, is cancelled) prior to the opening of the Event day (as applicable), you shall be entitled to a full refund of the face value of the Event Ticket and any Add Ons (if applicable) but no refund will be given in respect of any other expenditure whatsoever.

6. No refund will be made if the Event starts but is later abandoned.

7. If any of these Refund Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these terms and conditions are intended to be effective, then to the extent and within the jurisdiction in which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from that term and the remaining terms and conditions shall survive and continue to be binding and enforceable.

8. The Organiser expressly reserves the right to change and/or amend these Refund Terms from time to time.
